Smartmatic sues Newsmax and OAN for “disinformation campaign”


Smartmatic’s lawyers filed libel lawsuits against the two far-right TV channels on Wednesday, the first anniversary of election day 2020.

“Although they claim to provide viewers with honest and unbiased reporting, these media have victimized Smartmatic by spreading false information about the company after last year’s election, all as part of their efforts to increase the number of viewers and income, ”J. Erik Connolly, one of the attorneys representing Smartmatic, said in a statement.

Representatives for Newsmax and OAN did not immediately respond to CNN Business’s request for comment.

Smartmatic brought an action against Newsmax Media in Delaware Superior Court. The lawsuit accused Newsmax “of publishing dozens of reports indicating that Smartmatic was involved in a criminal conspiracy to rig and steal the 2020 US election and that its technology and software were used to pass the former’s votes. President Trump to current President Biden “.

The lawsuit alleged that Newsmax promoted election lies “as a tool in its competition against Fox News”.

Newsmax ratings soared when Fox identified Joe Biden as president-elect. Newsmax has sought to appeal to Trump fans by refusing to acknowledge Biden’s victory for weeks – and, according to the lawsuit, defaming Smartmatic.

“What Newsmax said about Smartmatic was wrong, but the damage it has caused to Smartmatic is real,” Wednesday’s filing said.

The case against One America News owner Herring Networks has been filed in the United States District Court for the District of Columbia.

The lawsuit said One America News aired numerous segments last winter that advanced false accusations of voter fraud.

The first time this happened could be a mistake. The second, third, fourth and fiftieth times this has happened were intentional choices, “the lawyers wrote.” OANN had every chance to do the right thing after the 2020 election for president and the Vice President of the United States. He could have reported the truth. Instead, OANN chose to do the wrong thing every time. He reported a lie.

Smartmatic said in the lawsuits that the two networks are responsible for “disinformation campaigns” that have harmed Smartmatic and negatively impacted the company’s operations. This is the same charge Smartmatic brought against Fox News in February when it filed a libel suit against the network for $ 2.7 billion. Fox sought to have this lawsuit dismissed.
Another voting tech company, Dominion, filed a libel lawsuit against the two networks in August. (Dominion had already sued Fox in March.)

In a defense against the Dominion lawsuit, Newsmax said it “was content to report allegations made by well-known public figures, including the president, his advisers and members of Congress” and argued that the Dominion’s action is “a clear attempt to quash such reporting and undermine a free press.”

One America News did not issue a response when the lawsuit against Dominion was filed, but the network previously claimed it was not responsible for disseminating the opinions of others.
