Norwegian communications regulator fines Telenor media service 15M NOK – JURIST – News


The Norwegian National Communications Authority (Nkom) on Tuesday fined media service Telenor for violating non-discrimination obligations, creating a disadvantage for access buyers.

The announcement, which was first made in March 2021, fined Telenor NOK 15 million for the violation. The media communications department was found to be negligent in delivering Access Buyers’ orders on an agreed date compared to their own commercial deliveries. It was found to be anti-competitive.

The fine will serve as an “infringement fee” to show the seriousness of the breach of the Marché 3a obligation, which aims to prevent discrimination “in the wholesale market for local access to fixed access networks”. The objective of the obligation was to ensure equal service between access purchasers and Telenor’s end-user company.

In a complaint filed by Global Connect, it was alleged that Telenor’s disproportionate treatment violates the obligations of suppliers. It was also requested that the communications department provide a report of their key performance indicators (KPIs) in a more detailed and consistent manner, in order to ensure that Nkom can access discriminatory behavior more quickly.

Nkom chief Hans Jørgen Enger said the growing market power Telenor was deriving from their shares violated the “special obligations” in place. As a result, Telenor was hurting competition in the broadband market.
